Welcome to the Internet Site of GTA Furniture Central Inc. and its divisions:  WSE Designs, The Futon Loft, and Waterbed City.  This Internet Site is owned and operated by GTA Furniture Central Inc. (referred to herein as "The Company").   PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS INTERNET SITE since both use of this Internet Site as well as all sales of products and services offered on this Internet Site are subject to the legal terms and conditions outlined below (collectively, the "Terms and Conditions").

Your use of this Internet Site in any manner, including browsing or making a purchase, constitutes your acknowledgement that you have read the Terms and Conditions and that you agree to follow and be bound by them.  The Company reserves the right to modify or change the Terms and Conditions at any time without prior notice to you.  Your continued use of the website signifies your acceptance of such revised Terms and Conditions; therefore, we urge you to read them carefully each time you use this Internet Site.

Your privacy is important to us.  We are committed to respecting your privacy through the protection of your Personal Information.  Our collection of Personal Information is limited to only what is required under the circumstances and your information will be used only for the purpose for which it is collected.  Your Personal Information is kept confidential and secure and is not disclosed to anyone outside The Company and our selected third party service providers/business partners without your consent, unless required by law.

Security 
All internet monetary transactions on this site are performed through our PayPal portal. Please review the Verified by PayPal security policies for more information.

The Company makes every effort to ensure that the Content on this Internet Site is complete and current. However, The Company does not guarantee that the information contained on this Internet Site will not contain errors, inaccuracies or omissions. Such errors, inaccuracies or omissions may relate to price or to product description or availability. The Company reserves the right to correct any error, inaccuracy or omission or to change or update the Content without prior notice to you. Further, The Company reserves the right to refuse or cancel any orders containing any error, inaccuracy or omission, whether or not the order has been submitted, confirmed and/or your credit card has been charged. If you have been charged for the purchase and your order is cancelled, The Company shall promptly issue a credit to you via PayPal.

If you feel that there is an error in the price or description of a product, please contact us for clarification.  The Company reserves the right to change prices without prior notice. All orders are contingent upon the product ordered being available.

We want your experience of shopping online with us to be enjoyable. All prices displayed on this website are in Canadian Dollars.

Colours

Please note that although The Company attempts to display the colours of the product shown on this Internet Site as accurately as possible, we cannot guarantee that the colour you see matches the product colour, as the display of colour depends, in part, upon the type of computer monitor used by you.

Sizes

The dimensions and/or sizes for all products are given on the information pages.  Please double check your dimensions to ensure that any product you are ordering will fit into the space in which you intend to use it.  Under no circumstances will products be accepted for return, and no refunds given, if the product does not fit.

Order Confirmation

An email confirming your order will be sent to the address you specified in your account.  If you make a mistake, contact us immediately.  If your order has already shipped, see Cancellation of Orders.  If you do not receive an email confirmation, please contact us immediately.

Order Cancellation Policy

Once an order has been placed, it can only be cancelled within the first 12 hours from the time it has been placed.  After that, your order will be in process for production, packing and shipping. 

If you cancel an order of regular stock items after 12 hours of placing the order and prior to shipping, you will receive a refund minus a $10 processing/restocking fee. 

If you cancel an order of non stock or special order items which is in production, you will receive a refund minus a 50% processing/restocking fee.

If your order has shipped, then our Returns Policy (below) applies.

The Company reserves the right to cancel any order at any time for any reason seen as appropriate, and credit back via PayPal the appropriate funds.  You will be notified in this circumstance.

Order Status

We will send you a tracking number for your order by email once it has been shipped.

Back Ordered/Out of Stock Items

We will contact you by email or telephone if any or all items ordered are not currently available to discuss your options and alternatives.

Returns Policy

Warranty Returns:

The Company carries quality products from reputable manufacturers.  All warranties are provided by the manufacturers of the goods including any extended warranties and not by the Company. The Company will act as an agent for these manufacturers to provide replacements or repairs (when warranty status confirmed) during full coverage periods only. Any pro-rated or extended period warranty claims must be made directly to the manufacturer of the product.  Warranties do not include any shipping, handling or service costs, which remain your responsibility.  All warranties are restricted to the specific product to which they apply, and do not cover any incidental damage to property or possessions.

If a warrantied product needs to be exchanged due to a defect, please contact us first with the following information:

1) The purchase invoice number

2) The problem with the item    

After this information has been received, The Company will contact you for any further information needed and then issue you with a return authorization code and exchange details.

Returns cannot be accepted without a return authorization code.

Please note that returns must be sent freight prepaid.  Any returns sent back to The Company without a return authorization code, or sent to The Company collect, will be refused and sent back at the customer's expense. 

Shipping charges on the replacement item sent to you will also be your responsibility.

Non-Warranty Returns:

If you wish to return or exchange an item for any other reason, you must contact The Company within 7 days of receipt of the item to obtain a return authorization code.

Please be sure to double check your order before you submit it to The Company to ensure you are ordering the correct model, colour, and size.  Returned items will be subject to The Company's restocking/cancellation charge of 20% on stock items, and 50% on all non stock, made to order, or special order items, and all freight charges will be the responsibility of the purchaser.

Returned products must be in original packaging, and cannot have been used in any way.   Returns are always subject to inspection and acceptance by us.  Refunds will always be made back to you via the method in which you paid for them.

You will be responsible for all charges incurred in the event that you have provided The Company with incorrect shipping or other needed information.

Quality Assurance

All items are checked for quality before they are packed and shipped to you.  If your item arrives to you damaged, please contact us right away.  We will always do our very best to make things right for you, so please email us if you have any problems with your purchase.  Items that have been used or do not have their original packaging will not be refunded or exchanged unless they are under warranty.   Please see the Returns Policy above for details.

Absolutely no unauthorized returns will be accepted by The Company.

Conditions of Use

By using this website you are agreeing to accept these terms and conditions as they then read. This agreement also includes whoever you represent (including companies). It is your responsibility to read and understand them. You attest that you have reached the age of majority where you live and you can form legally binding contracts under applicable law.

This document is subject to change. If you do not agree to these terms and conditions, do use this site. The Company may revoke permission to use this site, close your account and/or cancel any orders at any time.

Limitation of Liability

The Company shall not be liable for any damages or injuries whatsoever arising out of or relating to the use of this web site, any web site linked to this web site or any products purchased whether or not such damages or injuries might be foreseeable and whether or not The Company or any of its Associates has been negligent.  Product descriptions are merely observations and do not form a guarantee, warranty or agreement on our part.

Indemnification

You shall indemnify and save harmless The Company, its officers, directors, employees, affiliates, partners, service providers, consultants, representatives and agents from and against any claim, cause of action or demand, including, but not limited to, reasonable legal, accounting and other professional fees brought as a result of your use of this Internet Site ONLINE SHOPPING.  In order to purchase through this Internet Site you must be the age of majority in your province/territory of residence and you must agree to pay for all charges noted on this Internet Site as payable by you.  All prices listed on this Internet Site are in Canadian dollars and all charges will be processed in Canadian dollars.  Furthermore, any product ordered or purchased from this Internet Site may only be ordered or purchased for non-commercial and lawful purposes and any other use is not permitted.  The Company reserves the right to limit the quantities of certain products which you can purchase through the facilities of this Internet Site.  In addition to any other rights or remedies, The Company may, in its sole discretion and without any limitation of liability, restrict or terminate your access to any part of this Internet Site at any time.

Your Obligations and Code of Conduct

You agree to provide accurate, current, and complete information about yourself as may be prompted on the website, and accept all risks of unauthorized access to such information.  You are responsible for ensuring that the shipping address is correct and accept any costs related any errors on your part.  You are responsible for payment of anything including shipping costs of anything that is ordered and shipped using your information.

The Company is not under any obligation to verify the actual identity or authority of any person using this website.

Prohibited or Unlawful Use

You warrant to The Company that you will not use this Internet Site for any purpose that is either unlawful or prohibited by the Terms and Conditions. You agree not to use this Internet Site in any manner which could cause it to be disabled, damaged, overloaded, or impaired or interfere with any other person's use and enjoyment of this Internet Site. You may not misrepresent your identity or location as a user and you may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through this Internet Site. THE COMPANY EXPRESSLY PROHIBITS ANY UNAUTHORIZED THIRD PARTY LINKING TO THE COMPANY’S WEBSITE, including links to the home page or any other page on the domain.

Governing Law

The Terms and Conditions as well as the use of this Internet Site, including any order or purchase made through this Internet Site shall be governed by the laws of the province of Ontario and the laws of Canada applicable therein.

Sales Tax

The Company charges sales tax in Canada for products ordered on this internet site based on the applicable combined federal and provincial sales tax rate of the location from which the order is being shipped.

User-Generated Content

This Internet Site enables you to submit user-generated content.  If you provide content, by completing a Customer Review, or asking a question, you grant The Company a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display what you have written throughout the world in any media.  You also grant The Company the right to use the name you submit with the Customer Review or question, if any.
